In addition to which last mentioned land called Konolea is the following lying above Kalo patches on River, viz:

Commencing at Small breadfruit tree at foot of Pali 2 Chains 56 Feet South 58° 30' West and across Kalo patches from Stake at Entrant angle mentioned in above notes, and running
South 35° East 4 chains 39 1/2 feet along Kalo patches to Stake, Thence
South 71° 30' East 6 1/4 chains along Kalo patches to Stake; Thence
North 38° East 2 chains 9 9/12 feet to Stake; Thence
North 31° West 8 chains 29 3/12 feet to the last mentioned Stake (20 feet from water) in the survey of Konolea – Thence following up course of river to Stake at foot of Pali and end of bottom land, Thence
North 26° East 3 chains 26 4/12 feet to Stake; Thence
North 31° West 14 chains 42 1/2 Feet to bread Fruit tree. Including an Area of 6 Acres and 922 Fathoms.

The rights of native Tenants are reserved.

Containing    Forty-four 219/1210     Acres, more or less excepting and reserving to the Hawaiian Government, all mineral or metallic mines of every description.

To have and to hold the above granted Land in Fee Simple, unto the said Thomas Brown, his Heirs and Assigns forever, subject to the taxes to be from time to time imposed by the Legislative Council equally, upon all landed Property held in Fee Simple. Provided always, and this grant is made upon the express condition, that the Said Thomas Brown his Heirs, Executors or Administrators shall, in all cases of dispute in relation to his or their rights, title or interest in the land hereby granted, or any part or parcel thereof, submit the same to the judicial tribunal of the Hawaiian Kingdom, and abide by the final decisions of those tribunals, without seeking the intervention of any Foreign Nation or Representative; and in case he or they shall refuse so to do, his or their estate therein and all of his and their rights, title and interest therein, shall cease and determine, and the same shall be immediately forfeited and escheat to the Hawaiian Government.

In Witness whereof, I have hereunto set my Hand, and caused the Great Seal of the Hawaiian Islands to be affixed, at Honolulu, this 31st day of October 1850.
