Proper application having been made to me September 8, 1913 by the Pioneer Mill Co., Ltd. Of Lahaina, Maui for the settlement of the boundaries of the land of Kapunakea, Lahaina, Maui as follows:

Dear Sir,
We hereby make an application for the settlement of the boundaries of the Ahupuaa of Kapunakea, Land Commission Award 11216 to Kekauonohi

The Pioneer Mill Co., Ltd. Claims the Ahupuaa of Kapunakea by virtue of a deed from the Haalelea Estate to Henry Gordon, November 19th 1866, recorded in Book 23, page 84.

No survey is contained in deed of Haalelea Estate to Henry Gordon or of H. Gordon to Campbell and Turten and nothing but investigation and evidence on the ground could settle these uncertain points.

We would asks you to kindly give this matter your immediate attention and notify us in advance of your coming to Lahaina.

J.I. [J.F.] Stacker being duly sworn, deposes and says, that he is Clerk of the Hawaiian Gazette Co., Ltd, publisher of the P. C. Advertiser, a daily newspaper published in the City and County of Honolulu, Territory of Hawaii; that the ordered publication in the above entitled matter of which the annexed is a true and correct printed notice, was published four times in the P. C. Advertiser, aforesaid, commencing on the twelfth day of September 1913 and ending on the 3rd day of October 1913 (both days inclusive), to wit: on September 12, 19, 26, October 3, and that the affiant is not a party to or in any way interested in the above entitled matter.

.... gs and that they did not affect the land that he represented for the Ii Estate as it was an land Commission Award inside of Kapunakea.

Mrs. Kahananui Lopez stated that she owned some land inside of Kapunakea and was satisfied with the outside boundaries. She also stated that she had lived in Kapunakea and the greater part belonged to the Alii. Mrs. Lopez is quite an old woman.

There being no person or persons present to object, I therefore decree that boundaries of the land of Kapunakea, Lahaina, Island of Maui are as follows:

Description of the land of Kapunakea, Lahaina, Maui.
Land Commission Award 11216 to Kekauonohi.

Beginning at a point on the beach and running by true azimuths and distances, excepting any previous certificates or kuleanas.

1. 256° 59' 817.5 feet along Mala and Wahikuli;
2. 321° 35' 1485.0 feet along Wahikuli [page 108]
3. 309° 20' 700.0 feet along Wahikuli to the North West corner of Grant 1891, No. 8 to D. Baldwin, the co-ordinates of said point refered [sic] to Government survey Trig. Station “Laina” being 3577.8 feet South and 3586.4 feet West;
4. 44° 44' 456.2 feet along Grant 1891, No. 8, to D. Baldwin;
5. 136° 14' 590.0 feet along Land Commission Award 10532:1 to Naolula;
6. 140° 44' 419.8 feet along Land Commission Award 486:1 to Kaei no Uloa;
7. 106° 59' 435.6 feet along land Commission Award 486:1 to Kaea no Uloa;
8. 92° 29' 780.0 feet along Land Commission Award 7749 to Kanakanui continuing to the sea;
9. thence following the sea to initial point, the direct Azimuth and distance being 174° 42' 831.4 feet.

The above description was filed October 9th 1913.

Mr. L. Weinzheimer asked the Commissioner to visit the land of Kapunakea.

The Court then adjourned to visit the land.

The Commissioner of Boundaries in company with Mr. L. Weinzheimer, representing the Pioneer Mill Co. Ltd. C.A. Brown, representing the interest of the John Ii Estate, also kamaaina H. Kamaunu and the surveyor, H. Young were in the party.

We visited the land of Kapunakea and the kamaaina H. Kamaunu and Surveyor H. Young showed the various points refered [sic] to by them in court.

The court then adjourned.

Honolulu, October 13, 1913
After hearing the foregoing evidence and having also visited the land in person with the kamaaina and surveyor and being perfectly satisfied by the evidence &c &c. brought before me, also my personal knowledge of Lahaina, Maui.

I therefore adjudge the foregoing metes and bounds in the description made by Huffman Young, surveyor to be the true and lawful boundaries of the Ahupuaa of Kapunakea, Lahaina, Island of Maui.
