The Ahupuaas of Kealahewa 3d & Puuepa 2d, situated in North Kohala, Hawaii, 3d Judicial Circuit

Waimea, April 19th, 1871

By adjournment from the 17th of April 1871, the Commissioner of Boundaries for the 3d Judicial Circuit met at the Court House in Waimea.

Due notice of the hearing of the application of W. C. Jones, attorney for Henry Christiansen for the settlement of the boundaries of Kealahewa 2d [3d?] and Puuepa, situated in the District of North Kohala, Island of Hawaii, 3d Judicial Circuit, having been given by advertisement in the Hawaiian Gazette of March 22d 1871 and the Anaokoa of March 23d, 1871, and notice personally served on the owners of adjoining lands as far as known, for the 17th day of April 1871, which hearing was continued until the 19th day of April 1871 at 10 a.m.

Present Henry Christiansen, the applicant, and at his request the hearing was adjourned until the 21st of April. On the 21st of April at 10 o'clock a.m. the hearing was again adjourned at the request of the applicant until the 24th of April at 10 o'clock.

On the 24th of April 1871 the case coming on to be heard. There were present W.C. Jones, attorney for the petitioner, R. H. Stanley, attorney for Akahi and the Hawaiian Government and S.C. Wiltse on the part of J. Wight, one of the Patentees of Puuepa 2d, [a?], Mookini & Kanehalau, patentees of a portion of Kealahewa 3d. W.C. Jones amended his petition by inserting the words No. 2 after Puuepa and changing the figure 2 into 3 after Kealahewa on the sixth line from the top, and by striking figures 2 and 1 on the first line of the second page of petition, and inserting in their place the figures “3” and “2”, and by striking out the words “Kealahewa 3” and inserting the words “by Opihipau” on the second line from the top of page [?] inserting the word “South” on 3d line from top, and by striking out the words “is patentee of” and inserting the word “in” on the fourth line from the [top] and by inserting the figure “2” and the words “Puuepa 1” and by striking out the word Hukiaa” on the sixth line from the top, and by inserting “North” onthe eighth line from the top of second page.

Petition read as amended as follows:

To the Honorable Rufus A. Lyman, Commissioner of Boundaries for the Island of Hawaii, Hawaiian Islands.
The petition of Henry Christiansen, of North Kohala, in the Island of Hawaii aforesaid, respectfully showeth:

That he is owner of two tracts of land known respectively by the names of Kealahewa 3 and Puuepa No. 2, situated in North Kohala, Island of Hawaii, aforesaid.

That said tracts of land were originally surrendered to the late M. Kekauonohi, in her lifetime by is late Majesty, Kamehameha [III] by the act of the 7th of June A.D. 1848 and partitioned to her by award of the land Commission No. 11216, as apanas Nos. 32 and 33, [page 36] and dated the 4th day of February A.D. 1855, in which the boundaries of said tracts of lands were not decided and defined; a copy of which said awards herewith shown in exhibit marked “A” and made a part of this petition; That said tracts of land were not surveyed at the time of the surrender and partition as aforesaid, but have since been surveyed according to the ancient land marks and boundaries, known to the kamaainas of the vicinity; a copy of which said survey with the map i ....

Decision
The applicant Henry Christiansen by W.C. Jones, his attorney, having no record testimony to file, I decide, and certify the boundaries of Puuepa 2d, situated in the District of North Kohala, Island of Hawaii, to be as set forth in the description of boundaries in the following Certificate of Boundaries
