Land Patent No. S-8619 Issued In Confirmation of Land Commission Award
Whereas, the Board of Commissioners to quiet Land Titles, did, by its decision, award by Land Commission Award No. 3620, Apana 2 to Kaupe, an estate in Fee Simple in the land hereafter described, and
Whereas, application has been made to the Board of Land and Natural Resources by Janice G. Hutton, Kimo A. Hutton, Alexis K. (Hutton) Talpash, Duncan W. Hutton and Harvey D. Hutton, claiming to be the present owner of said land for a Patent covering same, and
Whereas, the award was made by survey, the description of which is found on pages 501-502, of Volume 4 of Land Commission awards, on file in the Department of Land and Natural Resources, and
Whereas, there is no government commutation due thereon.
Now, Therefore, the State of Hawaii, in conformity with the laws of the State of Hawaii, by this Patent makes known to all men that it has this day granted and confirmed absolutely, in Fee Simple, unto Kaupe, all the land situate at Niumalu in the District of Puna, Island of Kauai, State of Hawaii, bounded and described as follows:

Remarks
Land Commission Award No. 3620, Apana 2 to Kaupe was adjudicated on September 26, 1851, free and clear of commutation, as provided under Section 1 of the Act of August 6, 1850.
It should be understood that the patent, in this instance, should cover only the 0.25 acre as described in Volume 4, pages 501-502, of the Land Commission Awards on microfilm filed with the Division of Land Management, Department of Land and Natural Resources, State of Hawaii. The patent should not include, for lack of documentation, the remaining portion of Tax Map Key 3-2-02:4 (0.68 acre) which is noted on tax maps as accretion to Land Commission Award No. 3620, Apana 2. According to Security Title Corporation the current owners of the land bearing Land Commission award No. 3620, Apana 2 are:
Janice G. Hutton, one-half; Kimo A. Hutton, Alexis K. (Hutton) Talpash, Duncan W. Hutton, and Harvey D. Hutton, one-half interest.
Recommendation
Authorize the issuance of a land patent as requested.
