Enclosed I take the liberty to transmit to your Excellency a verified copy of a deed for the land, which I cultivate for the present. given to me by Charles Kanaina, Esquire, with the consent of her highness the late Premier; The stipulations of the deed are of such a nature that as a new order of things is pending, I cannot feel satisfied nor safe, until I am sure that the land cannot be taken away from me. I have the more reasons to be anxious, as I have expended all I had to put the land in order and it would certainly be very distressing to me if I had to leave it. I have always strictly adhered to the conditions of the writing and shall certainly still in future endeavor to show that I am not unworthy of the favor which I respectfully beg.

I would under these circumstances humbly request that your excellency would notify me or cause to be notified, whether it is necessary ....

.... for they were ours (two) under Keeaumoku and Kaahumanu the chiefs, and at that time of Kekauluohi it was taken by Louzada in the year 1844. Food was growing on the land at that time. It was enclosed with fence and was cultivated. No one has ever objected to the present time.

Clark Makapaa, sworn, I was at Waikapu when that land was given away and I had heard at that time that it was Kekauluohi who had given those lands of Aoaohamau and Pualinapao and I had seen him (Louzada) talking with Kekauluohi. The water lands were bad at that time in that the disadvantage was greater than the advantage and the lot was not enclosed as it is at the present time. The land has been cultivated and it looks good. The expense for the materials for a fence and the building of it was great. The houses too were in bad condition whereas they are now in good shape. We lived close to each other which accounts for my knowing these things.
