To the Land Commissioners, Greetings: I, the undersigned, hereby state my claims for a houselot at Lahaina, Island of Maui. It is at Pauna`u, on the east of the foreign church, and on the south of the lot of Kahula, on the north of the lot of Keaweluohe, on the west of the lo`is of M. Kekuanaoa and Maluwahi's houselot. The length of my occupation was from the dispossession of my kaikunane in the year 1838, and /from that time/ I have really lived in this houselot which I present before you. In the year 1842, or halfway, perhaps, on the death of Hoapili wahine, Kekauluohi divided the lot in half and Kanaina lived on half and I had the remaining half. But, the law says that the people had a right if they had it before 1839, therefore I am telling you of my entire lot which should be returned to me. However, on the half on which I live, no one has objected until this day on which I am telling you. There are also some trees planted by my makuakane, three kou, six kukui, three very old breadfruits, and two springs. Two houses are my own, and four are for the retainers of Kanaina on the half of the lot which they took. Here is something: Kanaina has previously petitioned you that this entire lot is his, but I deny it, as the Law says.
Farewell to you, the commissioners whom the Mo`i has invested with his power.
I am, with thanks, your obedient servant.

Kinimaka, sworn, I have seen this place over which there is a dispute. I had first seen this house lot at the time Haipule had it in 1837. I had heard M. Kekauluohi say to Kaniu in that same year, "Inform your guardian Haipule to have his makai lot as a dwelling place for W.C. Lunalilo's guardians (Kaaha and group)", Kainiu did as he had been bade to do and Haipule complied. They moved to the upland and the tenants enclosed the place where Haipule built a pili house. They also had access to the moo land.
