I, Kaikeoewa, Chief of Kauai agree that Richard Charlton may feed his cattle, sheep, fowls & other animals such as he may choose at Hanalei on Kauai, and he shall be allowed to feed them there 20 years from date, he shall not be oppressed nor taxed, nor pay rent for such feeding (pasturage) his animals. And I Kaikeoewa will make an enclosure (pen) for those cattle at Hanalei, and I will make clear the taking down the said cattle from Oahu to Kauai; he shall give me nothing for freight, any cattle however that may die, shall not be replaced. And Richard Charlton shall give to Kaikeoewa boards 560 for the house of Kauikeaouli.
And I, Kaikeoewa agree with Richard Charlton, his heirs & assigns that at the end of 20 years, he shall have two more years to clear the pasture & to dispose of his cattle and if the King shall compel Mr. Charlton to remove his cattle from said pasture before the term of years is ended, then there shall be paid him six hundred dollars.
And Kaikeoewa & Richard Charlton offer the names and seals in confirmation of the agreement.

No. 2: Know all men by these presents, that I, Mary Taylor at present residing at Honolulu, island of Oahu, for and in consideration of the sum of four thousand dollars to me paid on or before the signing of this instrument, the receipt of which I do hereby acknowledge, have granted, bargained, sold & confirmed, and by these presents do hereby grant, bargain, sell & confirm, unto Ann Dudoit her executors, administrators & assigns, all my right and title to the lease of a certain tract of land on the island of Kauai & known by the name of Hanalei, together with all houses, tenements and buildings, situated thereon & to me belonging, and also to a herd of cattle consisting of four hundred head and more, more especially known as Mr. Charlton's cattle; as also to all horses, mules and asses dispasturing on the said district of Hanalei, formerly belonging to /owned by the aforesaid Richard Charlton according to the bill of sale by him to me and executed under date 24 October 1845 and unto these presents attached without any account to me or any other person whatsoever hereafter to be rend ....

Connected with which is the certificate of General Miller, of the acknowledgement before him of the transaction between them, by an accredited agent of the contracting parties, and dated 30 December 1845. With General Miller's certification of the foregoing instrument having been registered in the Record Book in his Office at the British Consulate and dated 6 June 1846.

I, Kaikiohewa, the Chief of Kauai, hereby consent for Richard Charlton to raise cattle, sheep and birds /manu/, as he wishes, at Hanalei, Kauai, from this day forth, for twenty years. And he shall not be burdened or taxed or give tribute for raising these animals. And I, Kaikioewa, will build a corral /kahi paa/ for these animals at Hanalei and I will arrange for the transportation of these animals from Oahu to Kauai; there will be no payment to me and if perhaps some of them die on the ship I will not stop /the lease?/
And Richard Charlton will give to Kaikiohewa 560 boards for the house of Kauikeaouli ma.
And I, Kaikiohewa, hereby consent that Richard Charlton, his heirs and representatives, when the twenty years terminate, will be given two years in which to dispose of the animals by sale or otherwise.
And if the King shall demand of Richard Charlton that he remove his animals from this place before the end of the 20 years, Richard Charlton shall be paid $600.
In witness whereof, KAIKIOHEWA and RICHARD CHARLTON sign their names and affix their seals.

George Sandwich, sworn deposed, that he knew Captain Charlton sold some boards to Keikeoewa, but he did not know what witness knew that some money was paid by K[a]ahumanu to Charlton. Witness took the money in a bag to Charlton, he gave witness a kind of receipt for the money in English. Witness received the money from Keikeoewa and carried it to K[a]ahumanu, who counted it, and she told him to carry it to Charlton. K[a]ahumanu told Witness to get the lease of the Hanalei property from Charlton, and said nothing about the receipt, which was given by Charlton of his own accord. In the first place Mr. Charlton had written a lease for some land in Waianai, he gave it to me, and I carried to K[a]ahumanu 2nd, and she showed it to the King who was a little boy, and to K[a]ahumanu 1st. K[a]ahumanu 1st would not let him sign and kept the paper.

Nalimahauna's sworn testimony:
I have seen Kaikioewa give me the money, reported to Kaahumanu and from there to Kanikela, from whence he gave a receipt. I don't know the amount of the money but I know that Kaikioewa bought lumber. I do not know the quantity of this purchase and that is all I know about Kanikela's property on Kauai.
