Proceedings
In the Matter of the Settlement of the Boundaries of the Makai or Lower portion of the Ahupuaa of Paalaa, Waialua, Oahu, Territory of Hawaii
June 30, 1925, an application was filed by Waialua Agricultural Company, Ltd, through its attorneys; Robertson and Castle, setting fort that the Ahupuaa of Paalaa, Waialua, Oahu, was awarded to Victoria Kamamalu as Apana No. 34 of Land Commission Award 7713 by name only and not survey; that the petitioner as successors in title and interest to said Victoria Kamamalu is the owner of an undivided 25/27th part or share of all of the makai or lower portion of said Ahupuaa of Paalaa; the outer boundaries of which have not been settled or determined; and praying said boundaries be settled, determined and certified to be as follows:
Lot 1
Beginning at a pipe on the east side of the Government road, and being the northwest corner of Grant 607 to J.S. Emerson, the coordinates of said pipe referred to the “Maili” Triangulation Survey Stationbeing North 18397.35feet and West 4913.52 feet . Thence running by true azimuths as follows:
1. 201° 00' 00” 1589.2 feet along Government road;
2. 264° 27' 00” 595.85 feet along stone wall;
3. 275° 42' 00” 355.4 feet along stone wall;
4. 266° 45' 00” 407.24 feet along stone wall;
5. 210° 15' 00” 382.04 feet crossing the Helemano stream to its east bank;
6. 255° 30' 00” 146.5 feet along stone wall on the south side of Land Commission Award 2856, Apana 1 to Kea;
7. 235° 15; 00” 260.7 feet along stone wall on the south side of Land Commission Award 2856, apana 1 to Kea;
8. 151° 45' 00” 312.2 feet
9. 210° 45' 00” 385.4 feet along stone wall as per boundary certificate #36 of Kawailoa and Paalaa-Kai;
10. 214° 45' 00” 427.0 feet along same;
11. 240° 45' 00” 521.4 feet along same;
12. 225° 40' 00” 484.7 feet along same to a stone marked “A”;
13. 269° 45' 00” 483.8 feet along same;
14. 220° 15' 00” 170.3 feet along same;
15. 220° 45' 00” 156.0 feet along same to the center of Opaeula stream, the coordinates of [page 46] said point referred to the “Maili” Triangulation Survey Station being North 22242.2 feet; West 649.36 feet;
16. Thence running along same in a southeasterly direction, along the center of the Opaeula stream in all its winding to a bolt in large rock, the direct azimuths and distance being 283° 06' 30” 16034.9 feet, the coordinates of said bot referred to the “Maili” Triangulation Survey Station being North 18400.4 feet and east 15849.1 feet;
17. Thence running along same in a southeasterly direction along the center of the Opaeula stream in all its windings to a point which is by direct azimuth and distance 283° 11' 28” 20087.8 feet;
18. 341° 17' 38” 1688.0 feet along the same to U.S.A. Triangulation Survey Station “Peahinaia,” the coordinates of said survey station referred to “Maili” being North 12217.6 feet and East 35948.3 feet;
19. 341° 17' 38” 6450.0 feet along the west side of the remainder of Paalaa-uka called Ili of Helemano to the north bank of the Helemano stream;
20. Thence running along the south side of Paalaa-uka called Ili of Helemano in a southeasterly direction along the south bank of the Helemano stream to a point known as “Kaape Fishing place,” the direct azimuth being 281° 34' 4304. Feet;
21. 11° 00' 00” 900.0 feet along the remainder of Paalaa;
22. 50° 00' 00” 2700.0 feet along the remainder of Paalaa to a point, and from which point the Helemano Triangulation Station marked by a 1 ¼ inch galvanized pipe is by true azimuth and distance 115° 30' 560 feet, and the coordinates of said triangulation station referred to Government Survey Triangulation Station “Maili” being North 2866.9 feet, and east 39488.2 feet;

Hearing on this application was held August 8, 1925, at 9 a.m., Appearing were:

The Commissioner called to the attention of Mr. Greenwell, attorney for the application, the fact that notices of the hearing had failed to reach Antone Pedro and Mary C. Lopes, adjoining owners. At Mr. Greenwell's request and on his statement that the boundaries of the lands in which said Antone Pedro and Mary C. Lopes are interested are fully described in Royal Patent issued on Land Commission Awards and are not subject to the jurisdiction of the Boundary Commissioner, the Commissioner proceeded with the hearing without further attempt to reach these parties.
Mr. Hewitt stated that the boundaries as given in the application and on the accompanying map were satisfactory to the Territory of Hawaii..
Mr. Loomis stated that these boundaries were satisfactory to the Trustees of the Estate of Bernice P. Bishop.
Mr. Hore that they were satisfactory to Kualii Hore.
Mr. Poai and Mr. Kahakamoku also stated that the boundaries as given were satisfactory to them.
The principal adjoining owners being in agreement and no contest being entered on the part of the others, the Commissioner rendered the following decision.
Decision
I hereby find and decide the true and lawful boundaries of the Makai or Lower Portion of the Ahupuaa of Paalaa, Waialua, Oahu, Territory of Hawaii, to be as set forth in the application for settlement of boundaries filed with me by Waialua Agricultural Company, Limited, on June 30, 1925
