Professor Alexander presents the survey on behalf of the Estate of Kamehameha V. By reference to page 57 et seq. Of this record it appears that a certain decision was then made by the late Commissioner on the application of J.O. Dominis in the character of Commissioner of Crown Lands that Award is now said to be insufficient as it is by description merely and not by metes and bounds, and besides is an external description not excluding other lands lying within those bounds.

The Crown Commissioners are notified of this, meantime the case proceeds to determine the boundaries, whoever may be the owner.

Maui, E. Maui, sworn, This man is personally known to me as having been for a long time in charge of the land of his late Majesty, Kamehameha V in his lifetime & since. Says, Have been in charge of this land since the accession to throne of Kamehameha V. Have been in charge of the pond of Opu, and the appertenant [appurtenant] lands. The pond of Opu is the Kumu of this land. It and they have been Kamehameha V[‘s], undisputed in my knowledge. This I knew before I took charge.

This pond of “Opu” lies adjacent to Miki of John Ii, as in this map.

Note: This map and survey correspond with one in Estate of John Ii, just preceding in this book. Many of the lines determined by that and by Kalawahine.

Mauka of “Kanaha” is Opu including Puu Ohia, going to old heiau, which is the upper point of this land, thence down the ridge, where the stone rolls in Manoa, till you come [to] the rock, Pohaku o Kukalia; thence to summit of hill Ualakoa (Round Top). Thence down a sliding place.

The taro patches above Anapuni are of Kamehameha V. and not of John Ii (see last decision); Not crown lands.

Section 6. Waipahee is a lele of Opu, and belongs to Kamehameha V (boundaries of this are determined by 2 Royal Patents).

Major Moehonua for His Majesty, Kalakaua, concedes that the taro patches above Anapuni are not Crown lands.

Witness from[?] Kauhikio 1st to makai side of Kanaha, the edge of the bluff or pali is the boundary between this and the Government land, Kaiwiokaihu.

“Kumuulu” lies as it is on the map above Kaaiameawa which is between Kumuulu & Kauhikio II. There is a breadfruit tree exactly on the line.

Mauna Laha is a lele of Kaiwiokaihu, and borders Opu & bordered by it.

Napohaku, sworn, Is kamaaina of “Miki” The pond “Opu” borders this and is the Kumu of all the land of that name. I pointed out the line to Mr. Alexander where he surveyed it.

I know “Waipahee” is a lele of Opu & belonging to Kamehameha V.

The taro patches “Kauhikuikui” were made some by Kamehameha I, then by Kalaina, then by Kamehameha V, and John Ii did not possess or own them. They were the property of Kamehameha V.

Note: By the map and notes of survey it appears, that the several sections of land here described are defined and limited by the proper determinations of the boundary commissioner respecting Kalawahine, the Pawaa Estate of John I, Poloke, upper & Lower, the lots of Puu and Lukalikia &c., also by numerous grants and Patents which are enumerated in their plans A great part of its proper external boundaries were settle ....

.... orth side of the Valley, the boundary runs:
1. South 27° 43' East (Magnetic South 41 ½° East) 393 feet along Kauhikio 3rd, Royal Patent 4519, now belonging to Mr. Hering, thence
2. South 87° 37' East “true” bearing, 322 feet up the Pali, along Royal Patent 4519;
3. South 35 ½° West “true” bearing, 273 feet along the ridge to Kumuulu, a Government land, thence
4. North 49° 50' West (magnetic North 56 West) 555 feet, across Valley, along Kumuulu to J. Ii's land;
5. North 38° 30' East 288 feet along J. Ii's land to place of beginning.

Section 4. Comprising the Lands of Moho and Loko, Area 10 73/00 acres
Beginning at an iron stake at the summit of the dividing ridge adjoining Poloke and Kauhikio 3rd the boundary runs:
1. North 62° 35' West 785 feet partly across the gulch, along J. Ii's land to a marked rock at the end of a boundary wall;
2. South 24° 16' west 736 feet along J. Ii's land to upper end of stone wall, to Royal Patent 4519;
3. South 53° 15' East (Magnetic South 67° East) 242 feet along Kauhikio 34d, along taro patches;
4. North 18 ¾° East (Magnetic North 5° East) 156 feet along Kauhikio 34d to stream, thence
5. South 64° East 432 feet to summit of ridge;
6. North 36° 16' East 606 feet to place of beginning along Kauhikio 3rd.

Section 5 or Opu Fish Pond, Area 1 31/100 Acres.
Beginning at the upper corner of this near a granite post in General Miller's fence, the boundary runs:
1. South 13° 12' west (Magnetic south 5 ½° west) 107 feet along estate of J. Ii's called Miki, thence
2. South 3° 46' East 160 feet along J. Ii's estate called Miki,
3. South 27° 01' West (magnetic south 18° West) 203 feet along Miki to a concrete post at West corner of J. Ii's land, thence
4. North 46° 27' west (Magnetic North 55 ½° West) 197 feet, along Grant 2790 to L. Kamehameha;
5. North 18° 3' East [(] Magnetic North 8 ½° east ) 95 feet, along Grant 2341 to General Miller [page 288]
6. North 40° 42' East (Magnetic North 31° 50' East) 241 feet along Grant 2341, thence
7. North 60° 57' East 72 feet to the place of beginning

Section 6 or Waipahee, Area 1 78/100 Acres
A loi in Kalia, a lele of Makiki
Beginning at the west corner of this land, adjoining the Estate of Dr. G.P. Judd and Grant 3098, to L. McCully, the boundary runs:
1. South 52 ½° East Magnetic bearing, 219 feet along Grant 3098, thence
2. North 52° East Magnetic bearing, 251 feet along Grant 3098;
3. North 27 ½° West Magnetic bearing, 174 feet along Grant 3098;
4. North 47 ½° West Magnetic bearing, 129 feet along Grant 3098;
5. South 37 ½° West Magnetic bearing 135 feet along Grant 3098;
6. South 35 ¾° West Magnetic bearing, 195 feet along G.P. Judd's land to place of beginning.

Total Area 491 6/10 Acres
The average magnetic Declination is 9 ¼° East at this time.
