The undersigned guardians of the person and Estate of William C. Lunalilo would respectfully ask that the boundaries of the Ili of Kapahulu in Waikiki Island of Oahu may be defined and settle in accordance with the act approved June 22nd, 1868.

The said land is bounded as follows and Honorable Charles Kanaina will furnish when required the names of the witnesses to prove the boundaries

.... a, beginning at Kalahu & going mauka, Kapahulu would be on Honolulu side, and Waialae-Nui on other side. I don't know how far Waialae-iki comes towards Honolulu, for I did not go on Webster survey.

Cross-examined: My father's name was Kaawa. He was a witness before Kamakau. My father told me all this when he was old and feeble. He took me on the land and showed me boundaries on that side because there was some dispute. Our house was near Kupikipikio. We went up to Kalepeamoa; we went on foot. My father was one of Mahuka's kahus. It was after the case before Kamakau and Makalena.

S.K. Kaai, sworn, states, I have lived at Waialae at various times, with Mahuka, who was my uncle. The longest time I lived there was for about one year. I only knew of the boundaries recently when Mahuka showed them to me; he started from Kupikipikio [sic] to “Kamaiopili,” then round base of Daimond Head to Kalahu; from there to Government road; from there he said it went up to Kalepeamoa; he only went with me as far as Government road; he said a part of Waialae-iki covers and joined Government road and [page 20] Kapahulu. Telegraph Station is on Waialae-Nui; there is a pile of stones along there that he said was placed there when Webster made his survey. My Uncle lived there from time he was a child and my Grand-father before him. There was a woman, who was a relative of our family on the land before Mahuka. Her name was Kaholohau. After she died Mahuka came on the land, but they did not put in their claim for it. They let the Chief put in his claim for the land.

Cross-examined. I became attorney for Keliikolani in 1877. It was after that my Uncle showed me these boundaries. I think in 1878.

Lukia, wahine, sworn, states, I have lived at Waialae-Nui from about time the old Fort was destroyed up to present time. I don't know the boundaries between Kapahulu and Waialae-Nui. I heard the Telegraph Station was on Waialae-Nui.

C.J. Lyons, sworn, states, I have made a survey of that part of this island, but not of any particular lands. I have no notes of Webster's Survey.

R.W. Meyers, sworn, states, This map is Webster's survey of Waialae-nui. I got it at Keliikolani's house.

Mr. Hatch offers in evidence Royal Patent No. 3578 of Waialae-iki and and [sic] copy of notes of Webster's survey of that land.

Judgment
An application to decide and certify the boundaries of the Land of Iliaina of Kapahulu, District of Kona, Island of Oahu, having been filed with me on the 24th day of May 1883, by S.B. Dole and W.O. Smith, a majority of the trustees of the Lunalilo Estate in accordance with the Provisions of an Act to facilitate the Settlement of boundaries &c approved on the 22nd day of June A.D. 1868, now therefore, having duly received and heard all testimony [page 22] offered in reference to the said boundaries, and having endeavored otherwise to obtain all information possible to enable me to arrive at a just decision, which will more fully appear by reference to the records of this matter by me kept in book No. 2, page 6 and it appearing to my satisfaction that the true lawful and equitable boundaries are as follows, viz.:

Portion A.
Commencing at the Government Survey Station Maumae (Marked by an iron pin) from which the Survey Station Kaimuki bears South 12° 57 West true 2922 feet and Leahi Station bears South 27° 9 West true and running
1. North 28° 48' East true 2948 feet along Kekio, Land Commission Award 5931 to Pehu, the edge of Pali being the boundary;
2. 42° 33' East true 603 feet along same;
3. North 59° 22' West true 317 feet along same to cross on stone;
4. 47° 58' East true 2063 feet along same to the East corner of Kekio on edge of pali at a place called Paina;
5. North 81° 40' East true 520 feet along Waiomao (Crown) the edge of Pali being the boundary;
6. North 89° 41' East true 832 feet along same to a cross cut on a stone at a place called Kalepeamoa; thence
7. South 10° 8' West true 7186 feet along Waialae-nui to a point near a stone marked with a cross;
