In the matter of the settlement of the Boundaries of the Ili of Kapoino, Waiehu, Maui, Hawaiian Islands.

M.D. Monsarrat, sworn, I identify the map produced, and also notes of survey in connection with same. The notes of evidence are in accordance with the Blue lines on Survey showing the land of Kapoino (Notes of survey marked Exhibit A). The [?] adjoining land on the North East (Hananui to Will Birsh[?]) in an award by metes and bounds, and the land of Halelena is abounded by metes and bounds to E. Minor and adjoins this land on the mauka side. The land of Hananui is awarded by metes and bounds and runs to the sea. The sea being the boundary of Kapoino - The Blue line survey of Kapoino on the southern boundary is based on the evidence of Nuhiwa. The dotted red line on the tracing above the boundary based upon the evidence of (Nuhiwa). Kaaionalani, wahine. The notes of survey in accordance with Red dotted line on tracing. This land of "Kapoino" is contained in the Ahupuaa of Waiehu.
Nuhiwa, kane, sworn, My name is Nuhiwa. I was born in Wailuku and lived as a child at Waiehu and was married there. I know the land of Kapoino, having worked with the konohiki, Nawaaa by name. The land of Kapoino is bounded by E. Miner's land on the mauka side. The gulch of Waiehu bounds the land on the southern side and follows it to the sea. I know the land of Manokohala. In coming from mauka, the first land is Kapoino Nui, next Kapoino iki and then Manokohala. Manokohala joins Kapoino iki on the southern side. The Waihee road bounds Manokohala on its makai boundary. Kapoino goes to the sea. Hananui joins Kapoino on the Waihee side and runs with it to the sea and along the sea shore south to "Kalua." Papamuku is the point at which the northern boundary of Kapoino reaches the sea. From "Kalua" at the sea the land of Kapoino is bounded by Waiehu until it reaches the northern boundary of Manokohala. There are two Kapoinos. Kapoino nui and Kapoino iki. Both the Kapoinos belong to Lunalilo. Kapoino nui is the Ili aina of Waiehu and afterward became a "ku." Kapoino iki was an "ili" in Waiehu and remains an Ili at present. Kapoino nui became a "ku" during the lifetime of Hoapili kane and Hoapili wahine, on the giving of the land to Manuel for services rendered, on the death of Hoapili the land became the property of Auhea, the daughter of Hoapili. Auhea being the mother of Lunalilo, the land descended to him. Kapoino Nui had a fishing right named "Nuu Kukahi." Kapoino iki had no fishing right. The land of Manokohala is [page 2] is bounded by the Waihee Road on the Makai bo ....

Brown on behalf of the Government and Mr. [?] W.O Smith on the part of the Lunalilo Estate that Kapoino nui and Kapoino iki, should be considered as forming one land known as Kapoino and that the decision to the land should be considered as covering both Kapoinos as one.
Decision
The true, lawful, and equitable boundaries of the land of “Kapoino” (being inclusive of Kapoino Nui and Kapoino iki) are as follows: viz.
Commencing at the large rock marked with a cross on the south edge of road said rock being called “Pohakunui,” and adjoining the Ilis of Pohakunui and Halelena and running:
1. North 34° 00' East true 157 feet along the Ili of Pohakunui along road;
2. North 28° 20' East true 500.3 feet along the Ili of Hananui along road;
3. North 41° 25' East true 120 feet along Waiehu to broken rock;
4. North 75° 30' East true 281 feet along Waiehu;
5. South 20° 50' East true 593 feet along Waiehu crossing road to the Northwest corner of Land Commission Award 3434 to Kaapowale as pa aina;
6. North 46° 15' East True 380.8 feet along Waiehu along paaina and road;
7. North 57° 12' East True 341 feet along same;
8. North 73° 52' East True 360 feet along same;
9. South 60° 25' East True 229.7 feet along Waiehu along stone wall;
10. South 84° 22' East True 140 feet along Waiehu to the Northeast corner of Kamai's Kuleana, Land Commission Award 3443, Apana 2;
11. South 8° 40' East True 103 feet along Waiehu to stream;
12. South 75° 45' West True 902 feet along Waiehu up stream;
13. South 38° 20' West True 226 feet along Waiehu up stream;

And that the Ili of Kapoino has a sea fishing right between Papamoku and Kalua; said fishing right known as “Nuikakahi.”
