The Land of Honomaele, Island of Maui

In the matter of the settlement of the Boundaries of the Western half of the Ahupuaa of Honomaele, Island of Maui.

Honolulu, June 1, 1910

Proper application having been made to me, June 1, 1910 by D. Uaiwa Kikaha by his attorney in fact, J. Clive Davies of Honolulu, Island of Oahu, also M.S. Grinbaum by his attorney in fact, J. Clive Davies. Know all men by these presents that I, D. Uaiwa Kikaha of Island of Maui, the owner of an undivided one sixth interest or share in the Western half of the Ahupuaa of Honomaele, Island of Maui, Mahele Award No. 42 to Kahanu, do hereby make, constitute and appoint J. Clive Davies of Honolulu, Island of Oahu, my true and sufficient Lawful Attorney, for me and in my name to make application together with the owner or owners of the other five sixths interest or share in said Western half of said Ahupuaa, to M.D. Monsarrat, The Boundary Commissioner for the Second Judicial Circuit, Territory of Hawaii, to have the Boundaries of said land decided and certified to by said Commissioner and for me and in name to sign the application for the settlement of said Boundaries, and to conduct and prosecute the proceeding to final settlement and decision, and to appeal, if necessary, from the decision of said Commissioner to the Supreme Court, and to do and perform all other and necessary acts in the execution and prosecuting of the aforesaid business in as full and ample maner [sic manner] as I might do if personally present, hereby ratifying and confirming all that my said attorney shall lawfully do, or cause to be done, by virtue thereof.

Present: J.M. Monsarrat, Attorney for the Aplicants [applicants], the following letter was introduced.

Mr. M.D. Monsarrat, Esquire, Boundary Commissioner, Second Circuit Honolulu

Dear Sir:
The Government Surveyor informs me that the discription [description] of Survey incorporated in the Petition of M.S. Grimbaum and D. Uaiwa Kikaha for certificate of Boundaries of the Land of West Honomaele, Maui, has been examined and found correctly to describe said land without incroaching [encroaching] upon the Government Lands adjoining The Territory, therefore, and will not oppose the establishement [establishment] of these boundaries along the lines requested in the petition.

I do now certify the description of the boundaries as made by H. Horvel are the true and lawfull [lawful] boundaries of said land.
