In the Matter of the Application of the Territory of Hawaii by Robert D. King, Surveyor of the Territory of Hawaii, for a certificate of boundaries of the Ahupuaa of West Kaupakulua, (consisting of two separate portions generally known as "Makai" and "Inland"), in the District of Hamakualoa, Island of Maui.

Under date of July 9th, 1931, the Territory of Hawaii, by Robert D. King, Surveyor of the Territory of Hawaii, before the undersigned, as Commissioner of Boundaries for the Second Judicial Circuit filed its application for a decision and certification of boundaries of the Ahupuaa of West Kaupakulua, consisting of two separate - portions generally known as "Makai" and "Inland", in the District of Hamakualoa, Island of Maui, Territory of Hawaii, in accordance with the provision of Chapter 42 of the Revised Laws of Hawaii 1925.
In this application it is stated that Robert D. King is the duly appointed, qualified and acting Surveyor of the Territory of Hawaii;
That the Ahupuaa of West Kaupakulua, in the District of Hamakualoa, was awarded by name only to Namauu no Kekuanaoa by Land Commission Award No. 10474, Apana 6, and was also patented by name only to Namauu no Kekuanaoa by Royal Patent No. 4490;

That prior to July 1st, 1925, the then Surveyor of the Territory of Hawaii prepared a list of all of the Ahupuaas, Iliainas and Leles within the Territory of Hawaii of which there had at that time been no legal description by survey determined by metes and bounds either by incorporation of the same in Land Commission Award or Patent in confirmation of. award or patent, grant or Government deed, or deed of the Commissioner of Crown Lands, or Land Court Survey or Certificate of boundaries or by decree of a Court of competent jurisdiction of the Territory; that upon the completion of the list the Surveyor published the same in a newspaper- of general circulation throughout the Territory of Hawaii once in: each of four successive weeks together with the name or names of the last named owner or owners and together with a notice that unless such unsurveyed lands had their boundaries properly and legally determined prior to July 1st, 1925, the Territory should proceed to have the boundaries of such lands adjudicated as provided by law; that included within such list was the Ahupuaa of West Kaupakulua; that the owners of the Ahupuaa of West Kaupakulua failed to have the boundaries of the same properly or legally determined, or determined at all at any time prior to the date hereof;
That the lands bounding and adjoining the said Ahupuaa of West Kaupakulua to the best of petitioner's knowledge and belief are as follows:
Ahupuaa of East Kaupakulua, Ahupuaa of Haiku, Ahupuaa of Pauwela, Ahupuaa of West Kuiaha and Ahupuaa of East Kuiaha;
That the owners of the lands adjoining the said Ahupuaa of West Kaupakulua, together with their addresses, all to the best of petitioner's knowledge and belief, are as follows:

That the following is a particular description by true bearing survey of the outer boundaries of the Makai portion and of the Inland portion of the Ahupuaa of West Kaupakulua, the same being connected by co-ordinates to the Government surrey Triangulation system:

All that certain portion of Royal Patent 4490, Land Commission Award 10474, Apana 6, to Namauu No Kekuanaoa, known as the "Makai Portion."
Beginning at a point on the sea pali known as Kapuaiaaka, which marks the boundary between East Kuiaha and West Kaupakulua at the sea, the said point being 217° 43' 58" (true azimuth 377.59 feet from E. M. I. Co.'s Trig. Station "Paehala" on the western pali of "Paehala" ravine, about 175 feet from the sea pali, whose coordinates are 12869.6 feet North, 9877.1 feet West, referred to Government Surrey Trig. Station "Kapuai" and running by true azimuths from said point of beginning:
1. Along sea pali to a point which marks the boundary between East and West Kaupakulua, the direct azimuth and distance being 247° 41' 25", 1396.84 feet;
2. 3° 15' 1613.7 feet along kula along East Kaupakulua (Grant 771 to Hikiau) to a point on the Western pali of Kolealea ravine;
3. 356° 35' 2838.0 feet along Western pali of Kolealea ravine and along Kula along East Kaupakulua;

Beginning at the iron rail which marks the North East corner of this land and is about 1000.0 feet North of the Junction of Kaupakulua and Peahi-Makawao Roads, the true azimuth and distance being 233° 29' 46" 1063.24 feet from E.M.I. Co.'s Trig. Station "Aheong" near the makai boundary of this land and whose coordinates are 4093.6 feet South, 7375.8 feet West referred to Government Survey Trig. Station "Kapuai" and running by true azimuths:
1. 332° 30' 1947.0 feet along East Kaupakulua (Grant 771 to Hikiau) along kula along Western side of Kaupakulua Road crossing Peahi-Makawao Road at about 1025.0 feet;
