July 14, Received the following petition

Honolulu, July 8th 1873
Honorable Duncan McBryde, Commissioner of Boundaries for the Island of Kauai

Sir:
I beg to make application to you to settle and define the boundaries of the Ahupuaa of Wahiawa belonging to the Estate of his late Majesty Kamehameha V.

Wahiawa is bounded on one side by Kalaheo, Ahupuaa belonging to the Crown and by the Ahupuaa of Hanapepe on the other side. I do not know of any other lands adjoining.

On the receipt of the above application gave notice to James N. Gay, surveyor of my intention to have the boundary of Wahiawa settled and defined and summoned the natives on that and the adjoining lands to give evidence on the 20th of July 1873 the parties appeared and Mr. Gay handed to the court a survey of said land which he had been directed to make some months previously by J.O. Dominis, said survey was found to be correct, not only by the evidence of the several natives Hohoaia, Kanupaha, Naoa & others, but by taking them on to the land, and there pointing out, the different marks and stations, and from said evidence in Court, and on the land, the following decision was rendered.

Decision
The Western boundary of this land commences at a point on the sea shore on the South West point of the Wahiawa Harbour at a place known as Kewakua at which place an arch in the cliff has the sea running through it. Thence to the centre of a large pile of stones called Kukikaloa. Thence [page 4 ....

North 17° 26' East 4690 links alongcrossing several small gullies and through dam of Boiling down establishment and close past the west side of Bridge on Government Road to place called Kawaihaka, a large stone from whence bear Pohakea North 39° 56' West Judge McBryde's flag staff
North 13° 5' West a tree[?] in bush at head of this survey called Kapiliwahine
North 5° 20' East from Kawaihaka
North 10° 57' East 5281 links crossing a gully and passing 60 links to the westward of the N.W. corner of old stockyard to a stone with a split in it called Waipapaaaina. Thence
North 4° 40' East 3317 links crossing a gully several times to a large rock about 10 feet high with a split in the top (thus [diagram of two-peaked mountain] ) and called Kapuna, Thence
North 1° 30' East 7100 links on up through bush to a large tree on top of ridge and called Kapiliwahine the land above this is not accessible and without going to great expenses in cutting lines through bush cannot be surveyed further. The quantities therefore are computed therefor an assumed line drawn on plan from Kapiliwahine across to Puuauukea, and contains an area of 4173 acres.

There is a considerable portion of this land owned by Mr. Rowell but owing to bad survey cannot be correctly ascertained.

I hereby certify that the above notes are a correct survey of the boundary as pointed out to me and settled by Judge McBryde commissioner of Boundaries for Kauai at all my stations on survey Either a trench is cut (thus Y) or three stones let into the ground (thus [diagram on 3 dots at points of triangle]).
