Boundary of the Ahupuaa of Koloa, Waimea May 28, 1873

Dear Sir:
I hereby beg to request that you will, when convenient, have the boundaries of the following lands settled and defined.
The Ahupuaa of Koloa bounded E. by Mahaulepu and Haiku, belonging to the Estate of Kamehameha V, North by Kamooloa and Kalaheo, W. by Lawai and S. by the sea.
The Ahupuaa of Kikiaola bounded East by the Ahupuaa of Waimea North by Waimea & Pokii West by Ketaha and south by the sea.

Thereupon, appointed the 1st day of October 1874 for the hearing of the evidence in relation to the boundary of Koloa, and notified the owners or their agents of the adjoining lands to appear on the day above named at the court house in Koloa at the hour of 10 am.

George Charman, sworn, I am acquainted with the boundary since 1837 I was then living with Governor of Kauai. Kaikioewa. I was with the Governor when he went from Hanalei pointing out the boundaries of lands as he went along, came to the gap, sent for the old people living at Kamooloa, Governor then pointed out to us that this was the boundary of Koloa where the water sheds. Thence to a small water fall. Thence to a dry Kalo patch belonging then to Heaha, thence up middle stream to where stream forks. Thence up fork to hau bush. thence up [narrow] ridge to top of Kahili, don't know any further on this boundary. [page 122]
From the gap the Eastern boundary goes up the centre of the ridge to Puukahi. Thence down the spur to Haalulu. Thence to Maunakiloka near to a deep Umikeahewa [?] in stream. Thence through Pakikope between two round hills to a hau bush close to Paehewa house from that to a clump of rocks joining Wiliwili near where Mr. Hobs formerly lived, thence down by Catholic church to Kanoi (a goat pen), thence to the sea, don't know the place it enters.

I leased the Koloa land mauka adjoining ahupuaa of Haiku. Did not know that Haiku natives claimed part of this land

I understand that I leased the wood land on the side of the gap as part of Koloa.

I do not know why Kaikioewa sent for the natives of Kamooloa, think it was for food. They, the natives stated to me afterwards, that the boundary was at the gap. Ese was Konohiki of Koloa then, he claimed to the gap.
Dr. Smith, sworn, I remember riding through gap with Mr. Whitney. He told me that the gap was the boundary between Puna and Kona, the old boundary. This is about 30 years ago. Think Mr. Whitney would know these large divisions of land, have always heard that, that was the Boundary, till a few years ago, then heard that it was disputed. Think that a ridge ought to be the boundary. I have the opinion that Charman's people have often been cutting wood all the way to the gap.

The water from this side of the gap runs towards Hulaia
Kahookui, sworn, Nanu Kahookui was born in Hanapepe, lived in Koloa since 1844 and well acquainted with Koloa. know boundary in same places other places do not know. Boundary is at Gap (Hoaea). Thence to a place below, thru to a ohia tree where Kipu, Hulaia & Koloa join. Thence to old Kalo [page 123] patches near Keoki by the bank of the river. Thence to a stream, above that don't know. Ese told me this boundary. The boundary goes a little beyond Hoaea.

Ese was the Konohiki of both lands, Koloa and Hulaia. he was a stranger but knew th ....

South 22° 33' East 580 links to the easterly edge of a sand stone rock in the sea and on the west side of Kukuiula bay. The Southwest corner of this land and Southeast corner of Lawai and Keku, thence in an Easterly direction along the sea shore to place of commencement.

1875, Boundary of the Ahupuaa of Koloa
The circuit Court Fourth Judicial Circuit after confirming the Decision of the Commissioner of Boundaries in reference to the disputed part of the Northern Boundary ordered the commission to define and rectify [certify?] the boundary of this land adjoining the Ahupuaa of Weliweli. After hearing evidence and going on the land the Commission rendered the following decisions, not only in reference to that part adjoining Weliweli, but the whole land.
Decision:
The South East corner of this land commences on the sea beach adjoining the South West corner of the Government land of Makaweli at a place called Paapoko. Thence along Weliweli to a pile of stones, at Kanekolea. Thence to pile of stones Kamanomano. Thence to pile of stones Kapueo. Thence to pile of stones Kamaemae. Thence to Puuokakauhua. Thence continuing along Welewili [Weliweli] to Keauakahaea. Thence crossing the Maulele road to the South bank of the Waihohonu stream. Thence along south bank of said stream to 3 stones. Thence crossing said stream and on to a black rock on the South bank of the aforesaid stream. Thence to top of small hill called Kumanumanu. Thence to top of a conical hill called Puukaheanui. Thence to top of Laukahi the North West corner of Welewili; Thence along top of ridge bounded by Haiku to Omoi peak. Thence from Omoi to Hoaea. Thence to the South Bank of Hulaia river. Thence following along the southerly bank of said river to opposite a round hill called Kaaheula. Thence on to the top of a high peak called Kahili, the North West corner of this land and North East corner of Wahiawa. Thence down along ridge to Laukihaihai. Thence down side of Laukihaihai across stream [page 131] place in ridge called Kalualea the North East corner of the land of Lawai. Thence along ridge to top of Puukolu. Thence down along Lawai to Kahuamoa. Thence down along side of Keekee to red Bluff. Thence down side of hill and across plain to the 2 mile stone on the South side of the Government road. Thence along Keekee crossing gully to top of ridge called Kamahou. Thence to large hole at Namahana. Thence to Puukamalii. Thence to stone bolt in hole close to road way. Thence to the Easterly edge of a sandstone rock in the sea and on the West side of Kukuiula Bay, the South West corner of this land and South East corner of Lawai and Keekee. Thence in an easterly direction along the sea shore to place of commencement.
