Deed of Gift,
To all whom it may concern. Be it known that I, Kaikeoewa, Governor of the island of Attaoi, do give & bequeath to Thomas Bateman, Master of the Barque Cheviot, his heirs, executors and administrators, a lot of land on the island of Attaoi facing the wharf and near the mission settlement extending as far back in the interior as a yam patch belonging to the said governor, the said Thomas Bateman of London, his heirs, executors & administrators, to hold the same as long as grass grows & water runs, and in the event of my, Kaikioewa's death, the said Thomas &c &c &c shall hold the same under my heirs, executors, administrators or assigns.
This plot of ground consists of five hundred acres or more upon which is to be built a native house.

.... Kaikioewa could neither read nor speak English. The land said to have been given to Bateman was never occupied by Bateman or any other person for him. After Bateman left, this land was planted by the King & Government with cane and otherwise cultivated, and has been so improved by them ever since. I was agent of Government in raising cane on this land for more than 5 years. This is all I know.

James Y. Kanehoa, sworn and stated, "I was on a trip with Kaikioewa from Oahu and landed on Kauai. Kaikioewa asked me to remain on board and take care of the ship while he, with Mr. Pala and the captain, went on land. The next morning when I had gone on land, Kaikioewa asked me to return and take care of the ship and I did do this. I think the ship was enclosed there for two or probably three days. I did not see that document and I was not the interpreter. Biteman did not live on that land, neither did his assistant.
