By This Patent the Governor of the Territory of Hawaii, in conformity with the laws of the United States of America  and of the Territory of Hawaii, with the approval of two-thirds of the members of the Board of Public Lands of the Territory of Hawaii, makes known to all men that he has this day granted and confirmed unto Ahukini Terminal and Railway Company, Limited, , for the consideration of Three Thousand One Hundred Fifty-One Dollarls, $3151.00 paid into the Treasury, and in conformity with Part IV, Section 17 of the Land Act of 1895, and Section 342 of the Revised Laws of 1915, all of the land situate at Anahola, Kapaa & Wailua, in the District of Lihue & Kawaihau, Island of Kauai, bounded and described as follows:

Sold at Public Auction July 26, 1920.
Right of Way for a Railway across the lands of Anahola and Kamalomalo, being 30 feet wide, extending for 15 feet on each side of a center line described as follows

Right of Way for a Railway across the Lands of Anahola and Kamalomalo.
Right of Way 30 feet wide, extending for 15 feet on each side of the center line descrived as follows:

Beginning at a point on the boundary of Anahola and Aliomanu about 200 feet from the sea, by true azimuths 257° 50' 105 feet, from an upright pointed stone marked with an arrow at an angle in said boundary and 298° 4' 30” 341.1 feet from the Government Triangulation Station “North Base”, and running by true azimuths:
1. Along a curve to the right of 478.34 feet radius to point of tangent (station 2 & 91), which is 328° 05' 526.3 feet from “North Base”, the direct azimuth and distance being 4° 32' 30” 287 feet;
2. 22° 00' 1590 feet to point of curve (station 18 + 81);
3. Along a curve to the left of 1432.7 feet radius to point of tangent (station 23 + 06) the direct azimuth and distance being 13° 30' 423.5 feet;
4. 5° 00' 617 feet to point of curve (station 29 + 23);
5. Along a curve to the right of 478.34 feet radius to point of tangent (station 32 + 73) the direct azimuth and distance being 26° 00' 342.8 feet;
6. 47° 00' 105 feet to point of curve (station 33 + 78);
7. Along a curve to the left of 410.27 feet radius to point of tangent (station 39 +28.1) the direct azimuth and distance being 8° 30' 510 feet;

9. Along a curve to the left of 716.8 feet radius to point of tangent (station 51 + 54.6) which is 9° 24' 375.9 feet from the Government Triangulation Station “South Base” the direct azimuth and distance being 13° 30' 423.5 feet;

11. Along a curve to the right of 2292.0 feet radius to point of tangent (station 74 + 12.6) the direct azimuth and distance being 279° 45' 855.0 feet;

35. 27° 17' 1263.8 feet to point (station 117 + 42) on the Kapaa-Waipouli boundary 146° 12' 287.6 feet from a concrete post at a point in said boundary called “Keaka”, the coordinates of said post referred to the “Nounou” Triangulation Station being 1591.1 feet North and 12150.7 feet East.

The above described Right of Way is sold and may be used for railway purposes only, and subject to the condition that if the whole or any portion of said Right of Way shall be used for other than railway purposes, the title to same shall immediately revert to and revest in the Territory, and subject to the further condition that the railway operating over the above described Right of Way shall become and remain a common carrier and subject to all Territorial laws relating to Public Utilities in the Territory of Hawaii.

The above Right of Way is sold subject to the right reserved in the Government to grant other parties the privilege of crossing said Right of Way with such flumes, pipe-lines, power lines, roads, ditches and such other rights of way as it may deem advisable, provided such crossing or crossings shall not interfere with the operation of the railway over said Right of Way.

Containing 39.38  Acres, more or less.

To Have And To Hold the above granted Land unto the said Ahukini Terminal and Railway Company, Limited and its heirs and assigns forever.

In Witness Whereof, The Governor of the Territory of Hawaii has hereto set his hand and caused the Great Seal of the Territory to be hereunto affixed, this 13th day of September, A.D. 1920.
