In the Matter of the Application of the Pioneer Mill Company, Limited, for the Settlement and Certification of the Boundaries of Portions of the Ahupuaa of Puunoa 3, Lahaina, Maui, Territory of Hawaii.

Under date of August 17th, 1926, the Pioneer Mill Company, Limited, an Hawaiian Corporation, filed before the undersigned, as Commissioner of Boundaries for the second Judicial Circuit, its application for the settlement and certification of the boundaries of portions of the Ahupuaa of Puunoa 3, situate in Lahaina, Maui, Territory of Hawaii.

This application, and the Exhibits ´A´ and ´C´ attached to and filed with it, were and are in words and figures as follows:

That your petitioner is a corporation duly organized
and existing under the laws of the Territory of Hawaii with its principal place of business in Lahaina, Island of Maui, Territory of Hawaii;

That in and by Mahele Award 63 to N. Namauu, the Minister of the Interior by virtue of law did award to N. Namauu the above named land by name only and without survey;

That the outer boundaries of the said land have not at any time heretofore been settled, determined or certified by any judicial tribunal;

That your petitioner is the successor in title and interest to the said Namauu and the owner of portions of said [page 191] land and as such owner desires to have the boundaries thereof described by survey, determined and certified;

That attached hereto and made a part hereof and marked Exhibit "A" is a description by metes and bounds of the outer boundaries of said portions of the Ahupuaa of Puunoa 3, Lahaina, Maui, Mahele Award 63 to N. Namauu, herein sought to be determined and certified; That the said description so set forth in said Exhibit "A" of the boundaries as claimed by your petitioner is by a true azimuth survey and is connected by co-ordinates to the Government Survey Triangulation System; ´

Attached to this application and made a part hereof is a map or tracing marked Exhibit "B" showing all natural topographical features; permanent or otherwise, marked along said boundary lines, the bearings and distances of each course given in the description of survey and such other data from field notes as will make it practicable to re-establish any boundary mark or point that may become lost or destroyed;

That attached hereto, marked Exhibit "C" and made a part hereof is a statement showing the names of lands adjoining said portions of the Ahupuaa of Puunoa 3 the boundaries of which are herein sought to be determined and certified, also the names whereever known of the owners of said lands;

Wherefore your petitioner prays that upon receipt of this application you notify this applicant, also the owners of all lands adjoining said portions of the Ahupuaa of Puunoa 3 the boundaries of which are sought to be determined and certified of the date when you will be prepared to hear this application and that you do give proper legal notice of the date and place of hearing" of this application and after hearing you do decide, settle, determine and certify the boundaries of said portions of the Ahupuaa of Puunoa 3.

Beginning at a concrete post marked [triangle with dot in it] at the north corner of Front or Main Street and a road running mauka, the coordinate of said concrete post referred to the "Laina" Triangulation Station, being 5452.3 feet South and 5555.5 feet West, and running by true azimuths:

1. 242° 40´ 616 feet along road and Puunoa 2 to concrete post marked +;
2. 313° 45´ 188 feet along Hanakaoo;
3. 320° 30´ 129.4 feet along Hanakaoo;
4. 44° 40´ 195.4 feet along Hanakaoo;
5. 160° 15´ 100 feet along Kainehe;
6. 59° 10´ 511 feet along Kainehe to a point on the mauka side of Front or Main Street, 239° 10´, 25.4 feet, from a concrete post marked "V" on the makai side of said street;

Beginning at a point on the north side of the Kahoma Stream, the coordinates of this point referred to the "Laina" Triangulation Station being 234.2 feet south and 2131.9 feet west, and running by true azimuths;

1. 249° 00´ 314 feet, along Kuholilea 4, Land Commission Award 8559B, Apana 26 to W.C. Lunalilo;
2. 343° 00´ 170 feet, along Puako to the stream;
3. 49° 10´ 155.3 feet across stream along Paunau, Land Commission Award 7713, Apana 26 to V. Kamamalu;
4. 104° 00´ 118 feet, along Puunoa 1, Land Commission Award 8515 to Lahilahi;
5. 138° 00´ 165.6 feet, along Kuholilea 4, Land Commission Award 8559,
Apana 26 to W. C. Lunalilo to the point of beginning.
Containing an area of 1.20 acres.

Part 4
In Kanaha Valley

Beginning at a point on the south side of the Kanaha Stream, the coordinates of this point referred to "Laina" Triangulation Station being 1810 feet South and 1683 feet East, and running by true azimuths:

1. 53° 00´ 84 feet along Apana 2 of Land Commission Award 5017 to Kauhi in Kelawea;
2. 71° 30´ 119 feet along same;
3. 133° 00´ 25 feet along top of pali along Land Commission Award 7632 to Kahookano in Kelawea;
4. 121° 00´ 45 feet along Kelawea;
5. 191° 00´ 19 feet along Apana 3 of Land Commission Award9795-F to Kaumauma in Nakalepo to stream;
6. Northeasterly along the stream (the middle of the stream being the boundary) along Hanakaoo to the point of beginning, the direct azimuth and distance being 262° 48´ 235 feet.
Containing an area of 0.23 acres, a little more or less.

The above matter was taken up by your Mr. Alexander of the Land Department, with our Mr. Newton, the Deputy Surveyor, and if the changes meet with our approval please inform us to this effect.

The proposed modifications being acceptable to the applicant, and all parties interested, were noted on the several maps, in ink; the Pioneer Mill Company, Limited, asking that the boundaries be settled as so modified.

Commissioner: In the matter of the application of the Pioneer Mill Company, Limited, for a certificate for the settlement of the boundaries of Portions of Puunoa 3, Lahaina, Maui, Territory of Hawaii, the Commissioner finds that the boundaries as claimed by the applicant, as slightly modified by the Territory, and which modifications have been noted on the maps, are´ the true boundaries of the lands whose boundaries are sought to be determined, and certificate will be signed accordingly.

In the Matter of the Settlement of the Boundaries of Portions of the Ahupuaa of Puunoa 3, Lahaina, Maui, Territory of Hawaii.

An application to decide and certify the boundaries of Portions of the Ahupuaa of Puunoa 3, Lahaina, Maui, Territory of Hawaii, having been filed with me on the 17th day of August, 1926, by Pioneer Mill Company, Limited, in accordance with the provisions of Chapter 42 of the revised Laws of Hawaii, 1925, relating to the settlement of boundaries.

Now therefore, due notice of the time and place of hearing having been given, and all testimony offered in reference to the said boundaries having been duly received, and heard, and no person having appeared in objection thereto (as more fully appears in the records of the Boundary Commission of the Second Judicial Circuit, Territory of. Hawaii, in Boundary Commissioner´s Book No. 3, Pages 190 to 202, inclusive), in accordance with the decision then rendered, I find and certify the true and lawful boundaries of the Portions of the Ahupuaa of Puunoa 3, Lahaina, Maui, Territory of Hawaii, to be as follows:

Mauka Side of Main Street

Beginning at a concrete post marked [triangle with dot in it] at the south corner of Front or Main Street and a road running mauka, the coordinate of said concrete post referred to the ´Laina´ Triangulation Station being 5452.3 feet south and 5555.5 feet west, and running by true azimuths:

1. 242° 40' 616 feet along road and Puunoa 2 to concrete post marked +'
2.313° 45' 188 feet along Hanakaoo;
3. 320° 30´ 129.4 feet along Hanakaoo;
4.44° 40' 195.4 feet along Hanakaoo;
5.160° 15' 100 feet along Kainehe;

Beginning at a point on the North side of the Kahoma Stream, the coordinates of this point referred to the ´Laina´ Triangulation Station being 234.2.feet South and 2131.9 feet West, and running by true azimuths

1. 249° 00´ 314 feet, along Kuholilea 4 Land Commission Award 8559B, Apana 26 to W.C. Lunalilo;
2. 343° 00' 170 feet, along Puako to the stream;
3. 49° 10' 155.3 feet across stream along Paunau, Land Commission Award 7713, Apana 26 to V. Kamamalu;
4. 104° 00' 118 feet, along Puunoa 1, Land Commission Award 8515 to Lahilahi;
5. 138° 00´ 165.6 feet, along Kuholilea 4, Land Commission Award 8559, Apana 26 to W.C. Lunalilo to the point of beginning.
Containing an area of 1.20 acres.

Part 4
In Kanaha Valley

Beginning at a point on the south side of the Kanaha Stream, the coordinates of this point referred to ´Laina´ Triangulation Station being 1810 feet South and 1683 foot East, and running by true azimuths:

1. 53° 00' 84 feet along Apana 2 of Land Commission Award 5017 to Kauhi in Kelawea;
2. 71° 30' 119 feet along same;

4. 121° 00' 45 feet along Kelawea;
5. 191° 00´ 19 feet along Apana 3 of Land Commission Award 9795-F to Kaumauma in Nakalepo to stream;
6. Northeasterly along the stream the (middle of the stream being the boundary) along Hanakaoo to the point of beginning, the direct azimuth and distance being 262° 48'235 feet.
Containing an area of 0.23 acres, little more or less.
