.... m, and abide by the final decision of those Tribunals, without seeking the intervention of any Foreign nation or Representative, an in case he or they shall refuse so to do, his and their estate therein, and all of his and their rights title and interest therein shall cease and determine, and the same shall be immediately forfeited and escheat to the Hawaiian Government.

This grant is made upon the express condition, however, that in case a Marine Railway shall not be constructed thereon, within two years from the date of this instrument, sufficient and suitable for the building and repairing thereon, of such vessels as enter into the Harbour of Honolulu, or shall not be kept in sufficient repair, or suffered to fall into disuse for the period of two years, then the property and privileges hereby conveyed, shall escheat to and become the property of the Hawaiian Government.

And it is hereby covenanted and agreed, that no grant of land now belonging to the Hawaiian Government in Honolulu, shall be made for the period of twenty years from and after this date, for the uses and purposes hereinbefore stated.

In Witness whereof, I have hereunto set my hand, and caused the Great Seal of the Hawaiian Islands to be affixed, at Honolulu, this thirteenth day of October, in the year of our Lord one thousand, eight hundred  and fifty-two.
